A court has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation originates in a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to answer human smuggling allegations, he was detained in federal detention.

In her order, the court noted that the government lacks a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
